Abstract: Following the launch of the infringement procedure against Romania for enacting measures in the food trade industry, the public debate has been whether the rule compelling large retailers to acquire 51% of certain food products placed for sale from a short supply chain that involves a limited number of intermediaries and close geographical and social ties is compatible with EU law. The research addresses the realities of the industry, the current legal framework governing the Internal Market, the role of the Common Agricultural Policy and an attempt to anticipate the approach of the European Court of Justice.
