Abstract: The wearable industry is a rapidly growing field. The massive amount of health data from wearable devices has become a big concern for data privacy. The U.S. is a leader in wearables, and data privacy regulation is essential. This paper will explore legal systems ranging from international human rights law to national and state laws, extending from privacy rights to data privacy, especially health data for the wearable industry in the United States. Based on the uncertainty and evolving particularity of the sector, the paper will use a legal doctrine approach to explore possible human rights violations in the U.S. wearable industry in the flow of health data. Vulnerabilities in the field and the U.S. legal system have left much room for companies and governments to buy data through third parties and data brokers.
